ТРАНСФОРМАЦІЯ РЕГУЛЮВАННЯ ПРЯМИХ ІНОЗЕМНИХ ІНВЕСТИЦІЙ У ЄВРОПЕЙСЬКОМУ СОЮЗІ В УМОВАХ ГЕОПОЛІТИЧНИХ ВИКЛИКІВ

АНОТАЦІЯ
Статтю присвячено трансформації регулювання прямих іноземних інвестицій у Європейському Союзі у 2019–2026 рр. під впливом геополітичних і технологічних ризиків. Джерельну основу становлять Регламенти (ЄС) 2019/452 і 2026/1386, щорічні звіти Європейської комісії, матеріали Європейської рахункової палати й ОЕСР, а також офіційні документи США та Китаю. Розмежовано національні процедури скринінгу, коопераційний механізм ЄС і макроекономічну статистику потоків ПІІ, що унеможливлює пряме зіставлення часток заборонених угод із динамікою інвестицій. Встановлено, що у 2024 р. національні органи держав-членів опрацювали 3136 заяв і справ, 41% з яких перейшли до формального скринінгу; серед справ із рішенням 86% було дозволено без умов, 9% – із умовами, близько 1% – заборонено. До коопераційного механізму ЄС було передано 477 повідомлень, 92% яких Комісія закрила на першій фазі. Доведено, що Регламент (ЄС) 2026/1386 закріплює перехід від децентралізованої координації до мінімальної гармонізації: обов’язкових механізмів у всіх державах-членах, спільного мінімального охоплення, процедурних гарантій і уніфікованої звітності. Водночас остаточне рішення щодо конкретної інвестиції залишається за державою-членом.
